Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Sagacious Heritage Corporation ("Sagacious Heritage", "we", "us"), governing your access to and use of the Coco's Story service, including the web application, related APIs, and any paid subscription plans (the "Service").
By creating an account, clicking "I agree", or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference.
1. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you may use the Service only with the consent of a parent or legal guardian who agrees to these Terms on your behalf.
2. Your account
You are responsible for the activity that occurs under your account and for keeping your credentials confidential. We may suspend or terminate accounts for violations of these Terms, applicable law, or the rights of others.
3. Your content
You retain ownership of the stories, photographs, names, dates, and other information you submit ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, process, and display your User Content solely to operate, secure, and improve the Service. You represent that you have the rights to submit your User Content, including any information about identifiable third parties (e.g., relatives), and that doing so is lawful in your jurisdiction.
4. AI-generated content
The Service uses large language models to conduct interviews, extract structured information, and generate written narratives ("AI Output"). AI Output may be incomplete, inaccurate, biased, or fabricated. You are responsible for reviewing AI Output before relying on it; it is not a substitute for primary records or professional advice. As between you and us, you own the AI Output generated from your User Content, subject to any rights of third parties in the underlying inputs. We make no representation that AI Output is original or non-infringing.
5. Subscriptions and billing
- Payment processor. Paid plans are billed through Stripe, Inc. under Stripe's own terms and privacy policy. We do not store full payment card numbers.
- Auto-renewal. By starting a paid plan, you authorize us (and Stripe) to charge your selected payment method on a recurring basis at the cadence shown at checkout (monthly or annually) until you cancel. Your subscription will automatically renew at the end of each billing cycle at the then-current price. For annual plans we will send a renewal reminder to your email at least 7 days before each renewal.
- Cancellation. You can cancel at any time, in a single step, from Settings → Billing. Cancellation takes effect at the end of the current billing cycle, and you keep access through the period you have paid for. No phone call, retention survey, or support ticket is required.
- Refunds (US). Except as required by law, payments are non-refundable and we do not refund partial billing periods. For annual plans, you may request a prorated refund of the unused portion within 14 days of the initial purchase by emailing billing@sagacious-heritage.com.
- EU/UK right of withdrawal. If you are a consumer in the EEA or UK, you have a statutory right to withdraw from your subscription within 14 days of purchase. You agree that we may begin providing the digital service immediately, and you acknowledge that you lose the right of withdrawal once the service has been fully performed. To exercise this right, email billing@sagacious-heritage.com with the subject "Withdrawal" within 14 days of purchase. Refunds will be made to the original payment method, less amounts proportional to service already provided.
- Free trials. Unless otherwise disclosed at the point of offer, your selected paid plan will begin and your payment method will be charged automatically at the end of any free trial period unless you cancel before it ends.
- Disputed charges. Please contact billing@sagacious-heritage.com within 60 days of any charge you believe is incorrect before initiating a chargeback. Unjustified chargebacks may result in account suspension.
- Price changes. For price increases or material reductions in features that apply to your existing subscription, we will give you at least 30 days' notice by email before the change takes effect at your next renewal.
6. Acceptable use
You will not use the Service to violate applicable law or third-party rights; upload unlawful, defamatory, harassing, or sexually explicit content; upload malware or interfere with the Service; circumvent rate limits or security mechanisms; scrape the Service without our written authorization; resell or sublicense the Service or AI Output outside the scope of your subscription; use the Service to train a competing model; or impersonate, surveil, or harass identifiable living persons.
7. Intellectual property
The Service and its software, design, trademarks, and documentation (other than User Content and AI Output) are owned by Sagacious Heritage or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service under these Terms. "Coco's Story" and "Sagacious Heritage" are our trademarks.
8. Termination
You may terminate your account at any time from Settings or by emailing privacy@sagacious-heritage.com. We may suspend or terminate access for violations, legal requirements, or to protect the Service. On termination, your right to use the Service ends, any paid plan ends at the close of the current billing cycle, and we will make commercially reasonable efforts to make your data available for export for a limited period.
9. Disclaimers
THE SERVICE AND AI OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT AI OUTPUT WILL BE ACCURATE. Some jurisdictions do not allow these exclusions; in that case the disclaimers apply to the maximum extent permitted.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) USD $100. Nothing in these Terms limits liability that cannot be limited under applicable law (e.g., for fraud, gross negligence, or statutory consumer rights).
11. Indemnification
You agree to defend, indemnify, and hold us harmless from claims arising out of (a) your User Content, (b) your use of the Service in violation of these Terms or applicable law, or (c) your violation of any third-party right.
12. Governing law and disputes
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws principles. Any action will be brought exclusively in the state or federal courts located in San Francisco County, California, except that mandatory consumer-protection law may give you the right to sue in your local courts. Before filing any claim, you agree to first email legal@sagacious-heritage.com and attempt in good faith to resolve the dispute informally for at least 30 days. To the extent permitted by law, disputes will be brought only in your individual capacity and not as part of a class or representative action.
13. Changes to these Terms
We may update these Terms from time to time. For material changes, we will update the version above and notify you by email, in-product banner, or by re-prompting acceptance before the change takes effect. Your continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Service before the change takes effect.
14. Miscellaneous
These Terms, together with the Privacy Policy and any plan-specific terms presented at checkout, are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or in connection with a corporate transaction.
